Who is Behind Prop 98?
Most of the funding for this proposition comes from wealthy landlords and mobile park owners.
What is Prop 98?
On the surface, Prop 98 is about protecting property owners against the corporate abuse of eminent domain. But it contains some very problematic wording, specifically: it would prohibit the “transfer of ownership, occupancy or use of private property or associated property rights to a public agency for the consumption of natural resources”.
And it would make it impossible to "transfer an economic benefit to one or more private persons at the expense of the private owner"
What are the most devastating ramifications of this wording?
Prop 98 would prohibit not only the corporate appropriation of private property under eminent domain, it would prohibit PUBLIC appropriation of private property under certain conditions. This would impact our ability to implement environmental law, water quality provisions, and zoning regulations.
Additionally, because a "private owner" cannot be forced to bear any expenses under Prop 98, rent control would be eliminated as current rent-controlled units are vacated, and landlords are allowed adjust rents with no restrictions.
What about Prop 99?
Prop 99 also offers protection against the corporate abuse of eminent domain -- and that's ALL it does, without any hidden agenda.

The Berkeley No on Prop 98/Yes on Prop 99 campaign needs people to phone and walk Berkeley precincts, and to table at farmers markets. Remember, not long ago a similar measure, Prop 90, almost passed. So we can't assume that the sheer audacity of Prop 98 will guarantee its defeat.
